This website, https://porchandroad.com, is operated by Olenis LLC, doing business as Porch & Road. In these terms, "we," "us" and "our" mean Porch & Road and Olenis LLC. By visiting our site or buying from us, you agree to these Terms of Service and to the policies they link to, including our Refund and Return Policy, Shipping Policy and Privacy Policy. If you do not agree, please do not use the site.
We may update these terms by posting changes on this page. If a change is major, we will give reasonable notice before it takes effect. Using the site after changes are posted means you accept them.

We may refuse service to anyone for any reason at any time. Card information is always encrypted when sent over networks.
Section 5: Accuracy of Information
We work hard to keep the information on our site accurate and current, but we cannot promise it is always complete or up to date. We may change site content at any time.
Section 6: Prices and Changes to the Service
Prices are in US dollars and may change without notice. We may change or stop offering any product or part of the Service at any time.
Section 7: Products
Some products may be available only online and in limited quantities. Returns follow our Refund and Return Policy.
We do our best to show product colors and images accurately, but your screen may not display colors exactly.
We may limit sales to any person, region or jurisdiction, limit quantities, and discontinue any product at any time. Any offer is void where prohibited.
Section 8: Product Use and Safety
Please read and follow all instructions, warnings and age guidance that come with each product. This is especially important for products used in or around vehicles, power, water, chemicals, pets and children. Products are intended for normal household and personal use.
Section 9: Orders, Billing and Fraud Prevention
We may refuse or cancel any order. We may limit or cancel quantities per person, per household or per order, including orders that use the same account, card, or billing or shipping address. We may limit or refuse orders that appear to be placed by dealers, resellers or distributors, and orders that appear fraudulent or unauthorized.
If we change or cancel your order, we will try to contact you using the email, phone or address you gave us. If we cancel an order you already paid for, we will refund you in full.
You agree to give current, complete and accurate purchase information, and to confirm you are authorized to use the payment method you provide.
Section 10: Payment and One-Time Purchases
Payment is taken when you place your order. We accept the payment methods shown at checkout. Your payment details are processed securely by our payment providers, and we do not store your full card number.
All orders on Porch & Road are one-time purchases. We do not enroll you in any subscription, membership or recurring charge.

Section 11: Gift Cards
If gift cards are offered: gift cards cannot be returned or refunded, do not expire, cannot be exchanged for cash, and cannot be replaced if lost or stolen.
Section 12: Fulfillment and Shipping
Order processing and delivery times are estimates and are described in our Shipping Policy. We are not responsible for delays caused by carriers, weather or other events outside our control. Lost and damaged packages are handled as described in our Shipping Policy. You are responsible for giving us a correct shipping address. Orders shipped to a wrong address entered by the customer may have reshipping fees or may not be refundable.

If you believe material on our site infringes your copyright, send us: your signature (physical or electronic), a description of the material, your contact information, a statement that you believe in good faith the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and you are authorized to act for the owner. Section 17: Comments and Submissions
If you send us ideas, suggestions or other comments, we may use them without restriction or payment. You agree your comments will not break anyone's rights or contain unlawful content or harmful code. We may remove content we find objectionable.
Section 18: Errors and Omissions
Our site may sometimes contain errors in product descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct errors and cancel orders affected by them, even after you place your order. If your card was charged for a cancelled order, we will refund the full amount.
Section 19: Prohibited Uses
You may not use the site or its content for any unlawful purpose; to harass, harm or discriminate against others; to give false information; to upload viruses or harmful code; to collect other people's personal information; to spam, phish or scrape; or to get around the site's security.
Section 20: Disclaimer of Warranties and Limitation of Liability
We do not promise that the site will always be available, secure or error free. Except as stated in our policies or required by law, the site and products are provided "as is" and "as available," without warranties of any kind.
To the fullest extent allowed by law, Olenis LLC and its owners, employees, partners and suppliers are not liable for any indirect, incidental, special or consequential damages related to your use of the site or our products. Some states do not allow these limits, so in those states our liability is limited as much as the law allows. Nothing in these terms limits the rights you have under our Refund and Return Policy and Shipping Policy.
Section 21: Indemnification
You agree to protect and hold harmless Olenis LLC and its parent, affiliates, partners, employees and suppliers from any third-party claim, including reasonable attorney fees, caused by your breaking these terms or the law.
Section 22: Dispute Resolution
If you have a problem with an order, please contact us first. You agree to send a written notice of the dispute to support@porchandroad.com, including your name, contact information, what happened and what you are asking for. We will try to resolve it with you within 60 days.
Binding individual arbitration. If we cannot resolve a dispute within 60 days of your notice, you and we agree that any dispute, claim or controversy related to these terms, the site or our products will be resolved by binding individual arbitration, and not in court, except that either party may bring an eligible claim in small claims court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision is final and may be entered in any court with jurisdiction.
Fees. Each party will pay its own attorneys' fees. Arbitration filing, administration and arbitrator fees will be paid as provided in the American Arbitration Association Consumer Arbitration Rules.
Class action waiver. You and we agree that any dispute will be brought only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not combine more than one person's claims or preside over any form of class or representative proceeding.
Section 23: Severability, Waiver and Entire Agreement
If any part of these terms is found unenforceable, the rest still applies. If we do not enforce a right, we have not given it up. These terms and the policies posted on this site are the full agreement between you and us.
Section 24: Termination
These terms apply until ended by you or us. You can end them by no longer using the site. We may end them, or limit your access, if we believe you have broken them. Amounts owed before termination remain due.
Section 25: Time Limit for Claims
Any claim related to the Service must be filed within one (1) year after it arises, where the law allows.
Section 26: Governing Law
These terms are governed by the laws of the State of Nevada, United States.
